Minister of Foreifn Affairs to settle the dispute by appointing a Commission of medical experts, one to be nominated by the Government, one by the Company and the third by the two nominees, to examine and report on the passengers and to land those that were not suffering from trachoma and deporting those that were, which proposal was perfectly agreeable to the Company but was refused by the Government, who made a counter-proposal that the Commission be composed of three Government Doctors; this proposal was naturally refused by the British Minister.

The Co's General Manager then sought a personal interview with the President, accompanied by the Cois Government Representative. In this interview the Co sought to prevail on the President to agree to appoint the Commission as suggested by the British Minister, without any success, and there and then learned from the President himself that under no circumstances would he change the Government's determination in refusing the men a landing, preferring rather to pay damages instead, the exact words the President used were "Si hay reclamaciones, ye pago" which translated meant "If there be damages, I'll pay". Convinced therefore of the inutility of further efforts, orders were then sant to the Agents at Salina Crux to despatch the steamers "Landratschieff" and "Marie" so soon they were ready for sea, and accordingly on August 10th the "Marie" left for Hong Kong and the "Landratschieff" on the 15th. Before leaving however, aletter was sent to the British Legation advising that the steamers were leaving under protest.

On October 22nd, 1908, an approximate claim of damages, amounting to $3,076,184.87 was sent to the President of the Republic accompanied by a better explaining the cause of the same. This step was taken after due consultation with, and under the advice of the British Minister who said that a private settlement if it could be accomplished was the best
